The Demise of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the tension caused by the announcement of a new comprehensive peace framework for achieving ceasefire appeared – briefly – to have been contained. A senior US official spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: a renewed assault of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of opposing developments captured the bleak nature of the outgoing year. By day, political struggles are fought: optimistic declarations are issued from various governments. Significant resources is allocated on managing particular approaches. By night, Moscow clearly shows the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nocturnal Warfare

As Russia's attack progressed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was laid bare. Ukraine is equipped to monitor projectile deployments from enemy soil, a ability enabled by current data. From observation points, Ukrainian air force fighter jets that had been scrambled to counter approaching cruise missiles roared overhead – modern combat jets supplied to Ukraine by Western partners.

Soon thereafter, Kyiv's air-defence systems activated: several firings targeted at a Russian ballistic missile. This was a advanced protection mechanism at work, probably delivered by allied countries. Every firing jolts you unexpectedly, causing tremors. The moment of terror quickly gives way to sober acceptance: possibly the approaching threat won't strike its target this time, preventing destruction from ruin and another blackout.

Ongoing Risks

Soon after, a large-caliber weapon opened up on a aerial vehicle close by, part of a defensive team – most likely Western-made equipment. Unfortunately, the bullets missed the enemy aircraft – it pressed on overhead toward its objective.

Intermittently, this persisted until dawn. Kyiv awoke to the early updates: seven people killed, destruction and utility failures in numerous residences as a result of the nocturnal offensive. As always, everyone still continued their routines – enduring hostilities. But those full day demonstrated Ukraine's vital need on Western support – a need that neighboring countries are demonstrably unable to substitute in the short term.

Failed Diplomacy

The comprehensive proposal from American leadership generated strong feelings, discussion and deep concern – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new approach from US leadership adheres to the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually win the battle. This cycle will, no doubt, endure.

Political Considerations

It is convenient to criticize certain parties of persistently promoting Moscow's conditions. But that does not seem to be the whole story. American leadership works based on a principle well known to international relations experts: you cannot win at the negotiating table what you have lost on the battlefield. The American government believes that it is unrealistic to force Russia to surrender the land that it presently holds in Ukraine's occupied territories.

The problem is that while accepting these circumstances, American administration does nothing to deter Moscow, through words or deeds, from assuming that the status quo will not shift further in its benefit in the months ahead.

Divergent Views

Therefore, Russian leadership is convinced that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their incentive to sign a deal that does not give them the maximum possible gain is close to zero. There may be numerous efforts to end hostilities, but they will continue as long as Russia's leader remains completely certain in the result.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing lives and land but preventing a entire defensive failure until situations evolve in its favour.

Present Conditions

Factually, there are no genuine requirements for a truce. Now, individual motivations are entering the equation: political desires to negotiate peace and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the country's interests against any initiative Kyiv finds unworkable, so that their attention does not move to internal issues. And although their task will now be significantly challenging after recent developments, it remains very improbable that this will alter their fundamental strategy.

These two forces are influencing discussions.

Conclusion and Outlook

It took a just a single week to terminate the suggested clauses of the latest plan. Assertive and inconsistent approach of the matter by American leadership, resistance by Ukraine and the rest of Europe, along with pacifying measures of diplomats, and finally, recent disclosures, all achieved their purpose.

While new initiatives based on old ideas are imminent, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and show particular unwillingness to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, primarily depend on sustained allied backing.
